The undersigned does hereby make application for a credit account to Smoky Mountain Materials, Inc., hereinafter known as SMMI and by doing so, authorizes SMMI in connection with the establishment and maintenance of this account to investigate the credit worthiness and capacity of our company and its officers and/or principals. The undersigned as an authorized signatory warrants that all information supplied to SMMI is true and correct in every respect, that our company is financially able to meet any commitments made to SMMI and personally warrants that payment will be made on the designated due date following the invoice date as indicated on each invoice rendered by SMMI to us, notwithstanding our failures to receive any money due from others. It is mutually understood and agreed that SMMI at its sole discretion, may suspend credit to us prior to shipment of any orders whenever SMMI feels its position has become impaired or insecure. I/We agree that all transactions between our companies will be construed and determined according to the laws of the State of Tennessee and any litigation between us and SMMI will be exclusively within Tennessee jurisdiction unless otherwise chosen by SMMI, and I/We agree to accept service by mail. I/We agree to pay all cost incurred by SMMI in the collection of any outstanding balance or the recovery of any products by SMMI including reasonable collection agency and/or attorney fees in addition to all other damages. SMMI is hereby authorized to deliver goods without signature and/or to perform services at my/our request and to charge same to my/our account. This agreement shall continue until written notice to the contrary is given and accepted, which acceptance shall be evidenced by letter from SMMI. I/We have read and do understand this Credit Agreement and by evidence of my signature, agree to said terms.
